Terms of Use

These terms cover the Daily Workout AI Tracker app (the "app") and the dailyworkout.ai website (the "site"), operated by Daniel Gnecco ("we", "us"). By using the app or the site, you agree to these terms. If you don't agree, please don't use them.

1. The app license

The app is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add to the Standard EULA. If the two conflict on how the app is licensed, the Standard EULA wins.

2. Health and safety

Daily Workout gives general fitness information. It is not medical advice, and it is not a medical device. Workouts suggested by the app, the AI coach or the website picker are generic suggestions and don't know your full health history.

• Check with a doctor before starting a new exercise program, especially if you have a heart, lung, joint or other health condition, are pregnant, are recovering from an injury, or have been inactive for a long time.
• Stop exercising and get medical help if you feel chest pain or pressure, severe shortness of breath, dizziness or faintness, or unusual pain.
• Choose weights, speeds and intensities you can handle with good form, and train in a safe place.

You exercise at your own risk. To the extent the law allows, we aren't responsible for injuries that result from exercise you choose to do.

3. Free features and Premium

The app is free to download. The free version lets you log your daily workout, see your week and keep your streak. Premium unlocks today's AI-built workout, the unlimited AI coach, full analytics and the year heatmap, Apple Health import, rest days and streak freezes, and share cards. Features may change over time.

Subscriptions

• Premium is an auto-renewing subscription, offered monthly or yearly. On the US App Store on the date above, the prices were $4.99 per month and $29.99 per year. The App Store shows the current price for your country before you buy, and that price is the one that applies.
• Premium starts with a 7-day free trial where offered. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription.
• Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel any time in iOS Settings → your name → Subscriptions. Deleting the app does not cancel a subscription.
• Refunds are handled by Apple under its policies at reportaproblem.apple.com.

4. AI features

AI-generated workouts and coach replies can be wrong, incomplete or unsuitable for you. Use your judgment, skip or swap anything that doesn't feel right, and don't rely on the AI for medical decisions. Don't use the AI coach to ask about emergencies; call your local emergency number.

5. Your content

You keep ownership of the workouts, notes and other content you enter. You give us permission to process it only to provide the app's features to you, as described in the Privacy Policy.

6. Acceptable use

Don't misuse the app or the site: don't interfere with how they work, try to access them other than through the interfaces we provide, reverse engineer them where that isn't allowed by law, or use them in violation of any law.

7. Availability and changes

We may update, change or discontinue features. We'll try to keep the app working, but we can't promise it will always be available or error-free. We may update these terms; the date at the top shows the latest version, and continuing to use the app after a change means you accept it.

8. Disclaimers and limitation of liability

The app and the site are provided "as is" and "as available", without warranties of any kind, to the extent the law allows. To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, and our total liability for any claim is limited to the amount you paid for the app in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under consumer law that can't be waived.
